Introductory provisions

  1. The following text constitutes the regulations of the online store operated by
    at www.rosachains.com , the store operator is ROSA Agnieszka Rosa-Otto, ul. Wilcza 3/39 00-538 Warsaw
    These regulations apply to the Seller and all Customers using the services of this online store.
  2. The exclusive right to run the above-mentioned store is held by ROSA Agnieszka Rosa-Otto, hereinafter referred to as the Seller.
  3. All products offered in the www.rosachains.com store are new, free from physical and legal defects, and have been legally introduced to the Polish market.
  4. The models are made of gold (585 or 375), as well as precious and semi-precious stones, zircons and mother of pearl.
  5. Any complaints regarding the manner of providing services resulting from ignorance or non-compliance with these regulations will not be considered.

3.
Taking an order

  1. The online store sells products via the Internet.
  2. Orders placed on weekdays will be processed no later than the next business day.
  3. Order processing time is up to 10 business days.
  4. Placing an order in the online store constitutes acceptance of these regulations.
  5. Information regarding products in the online store www.rosachains.com does not constitute an offer within the meaning of the Civil Code, but rather an invitation to enter into a contract. By completing the order form, the Customer submits an offer to purchase a specific product.
  6. The Seller reserves the right to refuse to process an order, limit the payment method or request prepayment.
  7. The Seller allows payments to be made by bank transfer, via electronic payment via the tpay.com payment system.
  8. The photos and other forms of visualization and presentation of jewelry presented on the store's website do not reflect its actual size - they are for informational purposes only.

4.
Guarantee

  1. All products offered in the store are subject to the Seller's liability regime for non-conformity of consumer goods with the contract (applies to consumer sales) or - in the case of sales within the framework of business activities - warranty for defects in the goods sold on general principles (depending on which provisions apply in a specific case),
  2. Due to the delicate nature of our products, we hereby declare that broken chains are not covered by warranty, as such damage can only occur as a result of improper use. Broken chains are repaired free of charge by the company, but the customer is responsible for the cost of shipping the damaged chain to and from the workshop (ul. Wilcza 3, Warsaw).
  3. The warranty for ROSA Gold Chains products lasts one year from the date the customer receives the product. It covers damage resulting from manufacturing defects in the jewelry, but does not cover mechanical damage resulting from improper use.
  4. If the jewelry shows signs of being repaired outside the ROSA Gold Chains workshop (i.e. own repairs, repairs by jewelers not affiliated with ROSA Gold Chains), the product will lose its warranty.
  5. The warranty is considered based on proof of purchase.
  6. All out-of-warranty repairs are free of charge indefinitely. The customer is responsible only for any material wear and tear (e.g., if gold needs to be added to the product to complete the repair) or for any shipping costs to and from the workshop.
  7. After purchasing a bracelet with precious or semi-precious stones, we offer a replacement for a stretched elastic band or worn silk cord for 40 PLN. This replacement does not include loose beads. In such cases, we need the gold elements from the bracelet, and you can choose the stones from our current selection. They will be valued and replaced.
  8. We store repaired jewelry for a maximum of six months. It is then recycled, and the proceeds are donated to charity.

5.
Making changes and withdrawing orders

  1. You cannot cancel an order for a product that has already been shipped.
  2. Any changes to the order after payment must be agreed upon by telephone or email by both parties.
  3. An order that is not paid for or, in the case of a pickup order, not collected within 7 days will be automatically canceled.
  4. In the case of products from the Unique Items category, the waiting time for payment is 3 business days.

6.
Prices

  1. All prices are given in Polish zloty and include VAT.
  2. The price given for each product is binding at the time the Customer places the order.
  3. The pricing of our products is subject to change as the gold exchange rate changes.
  4. The Seller reserves the right to change the prices of products on offer, introduce new products to the online store's offer, conduct and cancel promotional campaigns on the store's website, or introduce changes therein.

7.
Receipts and invoices

  1. A receipt is attached to every completed order. A VAT invoice is issued at the express request of the customer, after providing all the information required for invoicing.
  2. Please keep your receipt or invoice in case of any returns or complaints.

8.
Order fulfillment deadlines

  1. The ordered product is shipped within the time specified for the given product* (applies only to shipments within Poland), via a courier company, the delivery cost is covered by the customer and is added to the product fee.
  2. Order processing time is from 2 to 10 business days.
  3. During the holiday season, the delivery time may be longer and reach approximately 10 business days.
  4. International shipments are shipped via UPS courier. All shipping costs are the responsibility of the customer.
  5. The Seller is not responsible for failure to meet the deadline due to reasons beyond its control, particularly in the event of force majeure. If circumstances prevent the order from being completed within the timeframe specified on the store's website, the Seller will immediately notify the Customer, providing an estimated order completion time. In such a case, the Customer may withdraw the order.
  6. Domestic shipments delivered via courier should arrive the next business day after shipment.

9.
Damage to shipments

  1. If the product is damaged by mechanical damage of external origin, the Customer cannot invoke his or her warranty rights, the right to withdraw from the contract, or any other rights.
  2. Before acknowledging receipt of the shipment, the Customer is obliged to check whether the packaging has not been damaged during transport.

10.
Returns and exchanges of goods

  1. Returns and exchanges are possible within 14 days of receipt. The item must not show any signs of use. The seal on the chain or string must remain intact, and a receipt or invoice must be provided.
  2. The Customer withdrawing from the Sales Agreement, in accordance with point 1 of this chapter, shall only bear the costs of returning the Product to the Seller.
  3. The fourteen-day period within which the Consumer may withdraw from the contract is counted from the day on which the Consumer took possession of the Product.
  4. The right to withdraw from a distance contract does not apply to the Customer in the case of a Sales Agreement in which the subject of the provision is a non-prefabricated item, manufactured according to the specifications of the Consumer (Customer) or intended to meet his/her individual needs.
  5. Both the Seller and the Customer have the right to withdraw from the Sales Agreement if the other party fails to fulfill its obligation within a strictly specified period.
  6. Returned Goods should be sent by courier to the following address: Agnieszka Rosa, ul. Wilcza 3 lok. 39, 00-538 Warsaw, together with the attached return/exchange form .
  7. The funds for the returned goods will be refunded within 14 days via the platform from which the payment was made or by bank transfer to the account indicated in the return form.
  8. Individually tailored products are not subject to returns or exchanges, including: products with engraving, rings made in sizes other than those available on the website, non-standard designs and lengths of chains and necklaces.
  9. If your ring size is incorrect, we offer free resizing within 30 days of purchase. After that, the service fee is 150 PLN. Size changes are only available within the sizes offered on the website.


11.
Gift card

  1. The gift card is valid for one year from the date of purchase.
  2. The gift card entitles you to purchases on the website and in-store in our boutiques.
  3. The gift card is not refundable or redeemable for cash.
  4. The purchase of a gift card is not eligible for a discount.
  5. The gift card cannot be used to purchase another gift card.
  6. The value of purchases may be equal to or greater than the amount assigned to the gift card, provided that the ordering party pays the difference.
  7. The gift card can only be used once. Any unused funds in your account will be forfeited and the code cannot be reused.
  8. Products purchased with a gift card can also be returned to the gift card, which is valid for one year.
  9. ROSA is not responsible for the gift card once it is issued. If the gift card is lost, damaged, or otherwise rendered inoperable due to the fault of the Buyer, ROSA is not obligated to accept any complaints.
